Will a Baby Born in Sweden Get Swedish Citizenship?

A piece of recent news making rounds was that a baby born in Sweden could get Swedish citizenship if the parents are both naturalized citizens of Sweden themselves. No international law, however, says children born within a country must automatically be given citizenship in that country.

According to Swedish online reviews, the legal reality is tricky and requires careful consideration of which country would be best for you and your family if you were looking to relocate for work or educational purposes.

Citizenship for a newborn

Most countries give citizenship to children born on their territory but some do not. Under Swedish law, these circumstances of the newborn parents are considered.

  • Swedish father and non-Swedish mother – A child born in or outside of Sweden to a Swedish father and non-Swedish mother or even if one parent is Swedish then that child automatically acquires citizenship under the new Swedish law from 1 April 2015.
  • Swedish mother and non-Swedish father – A child born in or outside of Sweden to a Swedish mother and non-Swedish father or even if one parent is Swedish then that child automatically acquires citizenship under the new Swedish law from 1 April 2015.
  • Parents of other Nordic countries giving birth in Sweden – Children born in Sweden will be of the same citizenship as their parents. A child born whose parents are both from Nordic countries is mostly given the citizenship of the mother while if the child’s parents are citizens of a country outside the EU, the parents must apply for a permit of residence for the child.
  • Adopted child – A child under 12 years of age and has been adopted by a Swedish citizen is automatically granted Swedish citizenship upon adoption if the adoption took place by Swedish adoption authority and law. A child 12 or more of age at the time of adoption may acquire Swedish citizenship by application submission.

Requirement for newborn citizenship

  • The parents need to apply for a residence permit for the newborn and they will also be granted a temporary residence permit for no more than two years.
  • For a temporary residence permit, the child must have a valid passport, from the country of origin. If the child does not have a passport, the parents need to apply for one as soon as possible.

Statement of consent (Important from the guardians)

A statement of consent from both the legal guardians of the child is required in the form of a signed letter where they declare that they agree to their child being given a residence permit to stay in Sweden.

The statement should contain all the info regarding the child, the guardians, and the consenting parent’s signature in printed form.

A child born in Sweden will automatically receive Swedish citizenship only if one of the parents was already a Sweden citizen at the time of the birth of the newborn.
